Terms & Conditions of Sale
  Prices stated herein are effective September 1, 2006 and subject to periodic revision by SyQwest Incorporated. No order resulting from this price schedule shall be valid until accepted, in writing, by SyQwest Incorporated at Warwick, Rhode Island. All orders are F.O.B. Warwick, Rhode Island or other continental United States production facility of SyQwest Incorporated. Payment shall be in U.S Dollars in compliance with arrangements agreed to between buyer and SyQwest Incorporated. Any tax, duty or other charges levied by any national government and/or by any state, provincial or municipal body thereof affecting this commodity shall be paid by the buyer. Buyer shall be responsible for customs brokerage fees, if any.

Delivery shall be quoted at the time of order receipt. SyQwest Incorporated shall not be responsible for delays beyond SyQwest Incorporated's control or for delays caused by freight carriers. Included in the pricing shown in this price schedule is the supply of commercial packaging generally suitable for UPS, air-freight or motor-freight routing.

 

Warranty
  SyQwest Incorporated warrants Bathy-2010 equipment to be free from defects in material or workmanship for a period of twelve (12) months from the date equipment is placed into service (as evidenced by the dated, returned Warranty Registration Card); or within thirteen (13) months from the date of shipment from SyQwest Incorporated, whichever occurs first.

The Bathy-2010 warranty shall cover parts and factory labor only. No reimbursement is made for field labor. Defective parts must be returned, transportation charges prepaid, to SyQwest Incorporated. Buyer is responsible for freight charges associated with SyQwest Incorporated returning the repaired or replaced part. Prior to the return of any item, the Buyer must request and receive a Returned Merchandise Authorization Number (RMA) from SyQwest Incorporated. Parts damaged by abuse (including seawater) will not be accepted for warranty replacement.
